1. Introduction

Welcome to the official website of OLIJEL and its IKS solution, an intelligent anti-theft system designed to enhance vehicle the protection of motor vehicles. These general terms of use (hereinafter the “Terms”) govern access to and use of this website and the services offered on it. By browsing our site or using our services (forms, quote requests, IKS mobile app, online platform, etc.), you acknowledge that you have read, understood, and accepted these Terms. If you do not agree with these terms, we invite you not to use the site or the associated services.

OLIJEL reserves the right to modify these Terms at any time without prior notice. The most recent version will always be available on this page, along with the update date.

2. Use of the website and services

2.1 Access conditions

Access to the site and its services is restricted to individuals of legal age according to the laws in force in their place of residence and who have full legal capacity to contract. The use of the site must comply with applicable laws and regulations.

2.2 Prohibitions

The user agrees not to:

  • Use the site or services for fraudulent, illegal, or unlawful purposes;
  • Attempt to access, copy, or misappropriate any technological element or protected content of the site, including the IKS system and its components;
  • Disrupt or compromise the security, operation, or integrity of the site (e.g., introduction of viruses, cyberattacks, abusive use).

Any breach may result in suspension or termination of access to the site and services, without prejudice to OLIJEL’s available legal recourses.

2.3 Accuracy of information provided

When using an online form or any other service of the site, the user agrees to provide accurate, complete, and up-to-date information. Any erroneous, misleading, or incomplete information is the responsibility of the user and may limit or prevent access to services.

3. Products and services

3.1 General description

The IKS system is an intelligent anti-theft solution for road vehicles, enabling immobilization to reduce theft risks and facilitate recovery in the event of an incident. Additionally, OLIJEL offers various associated services, including:

  • Management of online quote requests,
  • Access to a customer platform,
  • Subscription options for certain advanced features.

3.2 Availability

OLIJEL strives to keep information about its products and services up to date. However, the site content, including technical specifications, commercial offers, and pricing, may be changed at any time without prior notice. The availability of products or services may vary depending on regions, partners, and distribution conditions.

3.3 Specific conditions

Certain services, such as monthly or annual subscriptions, may be subject to specific conditions, including payment terms, a minimum commitment period, or cancellation procedures. These specific conditions are communicated to the client at the time of subscription and take precedence over the general provisions contained in the present notice in the event of a conflict.

3.4 Useful life, end of life (EOL) and end of support

  • Useful life (hardware): the IKS module and its accessories are designed for a 5-year lifespan depending on usage, environment, and installation conditions (temperature, vibrations, power supply, etc.). This duration does not constitute a contractual guarantee of uninterrupted performance during that period.
  • Consumables: wear items (e.g., internal battery or electronic parts) have a lifespan of 2 years and are covered under the standard warranty.
  • End-of-life (EOL) policy: OLIJEL may declare the end of sale (End-of-Sale), end of software maintenance (End-of-Maintenance), and/or end of support (End-of-Support) for a generation of products. After the End-of-Support date, no updates or assistance are guaranteed. Local immobilization functions may continue to operate, but some connected features (e.g., remote commands, notifications) may partially or completely cease depending on technical dependencies (cellular networks, mobile OS, cloud services, etc.). If the product reaches its end-of-life cycle, OLIJEL reserves the right not to renew a contract with the client unless the client upgrades the IKS product with new parts at their own expense, unless the company offers a replacement program during that period.

3.5 End-of-life / End-of-support notification

  • Proactive information: for duly registered customers (valid contact details and up-to-date consents), OLIJEL will strive to send EOL/EOS notices by email, app notifications, or SMS at least 12 months before the end of support when reasonably possible, followed by reminders at 90 days and 30 days.
  • Limitations: OLIJEL is not responsible in the event that notices are not received due to outdated contact information, the user unsubscribing, email filters, app unavailability, or technical/regulatory impossibilities.

3.6 Replacement after useful life / EOL – who pays?

  • Principle: unless otherwise agreed in writing (extended contractual warranty, exchange program, promotional offer), replacement or upgrade costs after the useful life or after EOL/EOS are borne by the client (hardware, installation labor, activation, travel).
  • Exchange programs: OLIJEL may occasionally offer buyback/exchange programs or trade-in discounts toward newer models; the terms (eligibility, discount, deadlines) will be published at the time of the offer.

3.7 Subscriptions and end of subscription

  • At expiration or termination of a paid subscription, connected features may be reduced or disabled, while local immobilization functions may remain depending on the configuration.
  • Reactivations, plan migrations, and reinstallations may incur fees.
  • Third-party dependencies (mobile networks, operating systems) may affect functionalities without incurring OLIJEL’s liability (see 4.4).

4. Responsibilities and warranties

4.1 Limitation of liability

The IKS system reduces theft risks without absolute guarantee. OLIJEL/IKS and its installers are not responsible for loss, theft, damages, financial losses, loss of use, or indirect/consequential damages, even with the system in place.

4.2 Limited warranty

  • The warranty covers manufacturing defects for 24 months from installation by an authorized installer. Exclusions:
  • Misuse of product, accident, unauthorized modification of product, disaster, vehicle electrical surge;
  • Normal wear and consumables (including backup batteries);
  • Defects from non-compliant installation or by uncertified third parties.

If installation is carried out by a dealer/partner chosen by the client, liability for installation errors lies with the installer. OLIJEL declines responsibility for incorrect installation by a third party.

4.3 Disclaimer for website and online services

OLIJEL does not guarantee that the website, mobile application, and associated services will be free from errors, interruptions, or technical failures. Access may be temporarily suspended for maintenance, updates, or issues beyond our control. OLIJEL cannot be held liable for data loss, service disruptions, or indirect damages related to use of the site.

4.4 Connectivity and third-party dependencies

Certain features require connectivity (cellular, Bluetooth, Internet) and/or third-party services/devices (carriers, phone manufacturers, operating systems, cloud services). Failures, standard changes, OS updates, or third-party decisions may degrade/terminate functionalities. OLIJEL is not responsible for interruption of service due to loss of connectivity or dependency to third party service providers.

4.5 Safety of use and valet mode

Valet mode disables/reduces certain protections to allow legitimate uses (workshop, parking, rentals). It may create a window of opportunity. Its activation is under the client’s responsibility, who assumes the risks. Never attempt to immobilize a moving vehicle.

5. General sales conditions

5.1 OLIJEL / Agent obligations

OLIJEL or its agent sells and installs IKS in accordance with communicated prices and terms. Installation must be carried out by an authorized installer. OLIJEL ensures the client is connected and the system is active upon delivery.

5.2 Client obligations

  • Pay monthly fees according to the chosen plan until the end.
  • In case of early non-payment, client must have the IKS removed by the original installer or an authorized dealer.
  • Maintain the vehicle and system in good condition, follow usage instructions, and contact support in case of anomaly.

5.3 Limitation – Support and replacement

In case of an apparent physical defect, the client contacts support at +1 (438) 379-6078 or support@olijel.com for diagnosis without delay. If a covered defect is confirmed, OLIJEL provides the defective part and certified technician labor free of charge during the warranty period. Outside warranty/EOL, fees apply (see 3.6).

5.4 Vehicle ownership transfer

In case of vehicle sale, the client must: (i) uninstall IKS or (ii) transfer ownership/license to the buyer according to OLIJEL procedures (possible fees). Accounts/subscriptions remain under the holder’s responsibility until the transfer is confirmed.

6. Intellectual property

All site content, including without limitation, logos, texts, images, videos, graphics, code, software, documents, and other resources, is the exclusive property of OLIJEL, or is subject to a user license granted by third parties. This content is protected by Canadian and international copyright and trademark laws.

It is strictly prohibited to modify, copy, reproduce, republish, download, display, transmit, distribute, or exploit any site content, in whole or in part, without prior written authorization from OLIJEL or the rights holder. Unauthorized use may result in legal action, including suspension to site access and potential civil or criminal prosecution.

Users are permitted to print or download parts of the content for personal, private, non-commercial use, provided materials are not altered and all copyright or intellectual property rights are preserved.

7. Personal data protection

OLIJEL places great importance on protecting users’ privacy and personal information. Any collection, use, and storage of data through this site are governed by our Privacy Policy, available separately on the site.

Data management is in compliance with applicable laws, including the General Data Protection Regulation (GDPR) and Quebec’s Law 25. These laws ensure transparency, security, and respect for users’ rights regarding their personal information.

The IKS mobile app may require access to certain device data (such as location or notifications), solely for service functionality, in accordance with our Privacy Policy.

By using our services, you agree that your data may be collected and processed according to the purposes described in our Privacy Policy.

The site may contain links to other websites or resources operated by third parties. These links are provided solely for user convenience and do not constitute approval or endorsement of the content, products, or services presented therein.

OLIJEL and its IKS solution exercise no control over such external sites and cannot be held responsible for their availability, accuracy, security, or content. Access to third-party sites is at your own risk and governed by those third parties’ policies, terms, and privacy practices.

9. Changes to terms

OLIJEL reserves the right to modify or update these Terms at any time without prior notice. Changes take effect upon their publication on this site.

Users are invited to regularly consult this page to remain informed of any modification. The date of the last update is always indicated at the bottom of this section.

10. Governing law and jurisdiction

These Terms are governed and interpreted in accordance with the laws of the Province of Quebec and Canada.

In case of dispute concerning interpretation, execution, or validity of these Terms, the parties agree to submit their dispute to the exclusive jurisdiction of the courts located in the judicial district of Longueuil, Province of Quebec, subject to possible appeal to the Quebec Court of Appeal and to the Supreme Court of Canada.
